1. Agreement to Terms

By accessing or using CleverMoat ("Service," "Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

CleverMoat provides automated security assessment services for web applications, including:

• SSL/TLS certificate analysis and validation
• DNS and email security configuration checks
• HTTP security headers verification
• Port scanning and vulnerability detection
• Data breach exposure checks
• AI-powered remediation recommendations
• PDF report generation and sharing

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use
• Be responsible for all activities under your account

3.2 Account Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you meet this requirement.

4. Acceptable Use

4.1 Permitted Use

You may use CleverMoat only for:

• Scanning domains and websites you own or have explicit permission to scan
• Security assessment and vulnerability identification
• Compliance and audit purposes
• Educational and research purposes (with proper authorization)

4.2 Prohibited Use

You agree NOT to:

• Scan websites or systems you do not own or have permission to scan
• Use the Service for illegal, malicious, or harmful purposes
• Attempt to bypass, disable, or interfere with security features
• Use the Service to conduct penetration testing without authorization
• Reverse engineer, decompile, or disassemble any part of the Service
• Resell, sublicense, or redistribute the Service without permission
• Use automated scripts to create multiple accounts or abuse the Service
• Transmit viruses, malware, or malicious code
• Violate any applicable laws, regulations, or third-party rights

5. Credits and Subscriptions

5.1 Free Plan

New users receive 3 free scans. Free scans are non-transferable and expire if the account is deleted.

5.2 Paid Plans

Paid subscriptions include:

• Starter Plan: $19/month for 20 scans per month
• Pro Plan: $49/month for unlimited scans

Subscription fees are billed in advance on a monthly basis. All fees are non-refundable except as required by law or as specified in our refund policy.

5.3 Credits

• Each scan consumes one (1) credit
• Unused credits do not roll over to the next billing period (Starter plan)
• Credits are non-transferable and have no cash value
• We reserve the right to adjust credit costs with 30 days' notice

5.4 Refund Policy

We offer a 14-day money-back guarantee for first-time subscribers. Contact us within 14 days of your initial purchase for a full refund. Subsequent renewals are non-refundable.

6. Cancellation and Termination

6.1 Cancellation by You

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access until then.

6.2 Termination by Us

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Use the Service for illegal or unauthorized purposes
• Fail to pay subscription fees
• Engage in abusive or fraudulent behavior

6.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account data within 30 days of termination. You may export your data before termination.

7. Intellectual Property

7.1 Our Rights

The Service, including all content, features, and functionality, is owned by CaesarLab and protected by copyright, trademark, and other intellectual property laws.

7.2 Your Rights

You retain ownership of any data you submit to the Service. By using the Service, you grant us a license to process, store, and display your data solely to provide the Service.

7.3 Scan Results

Scan results and reports generated by CleverMoat are licensed to you for your internal use. You may share reports with clients, auditors, or third parties as needed.

8. Disclaimers and Limitations

8.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 No Security Guarantee

CleverMoat performs automated security assessments but does not guarantee the identification of all vulnerabilities or security issues. Our scans should not be considered a substitute for comprehensive security audits or penetration testing by qualified professionals.

8.3 Third-Party Services

We use third-party APIs and services (SSL Labs, Shodan, etc.) for security scanning. We are not responsible for the accuracy, availability, or reliability of these services.

8.4 AI-Generated Content

Remediation suggestions generated by AI should be reviewed by qualified personnel before implementation. We are not liable for issues arising from following AI recommendations.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEVERMOAT AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless CleverMoat and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of third parties
• Unauthorized scanning of third-party systems

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review it to understand our data practices.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which CaesarLab operates, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law. You and CleverMoat agree to waive the right to a jury trial or participation in a class action.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CleverMoat regarding the Service and supersede all prior agreements and understandings.
